Dannii Minogue will not face any further action after comments she made on The X Factor last month caused outrage with viewers.
The Aussie judge made reference to Danyl Johnson's sexuality after his performance on the ITV1 singing contest - which didn't go down well with some fans of the show (4,000 of them in fact) who complained to Ofcom.
Dannii apologised for her comments after the show aired and Ofcom has now ruled-out any further investigation.
A statement from the TV regulators reads: "It was not outside the established nature of the programme for an X Factor judge to make such a comment especially in circumstances where the performer had placed information about his sexuality in the public domain."
"Ofcom did not discern a pejorative or homophobic intent behind her comment. Broadcasters need to exercise caution in this area, particularly when the subject of sexual orientation may foreseeably arise in the context of a live programme."
"In no way should the 'outing' of participants in television programmes be encouraged, condoned or legitimised."
