Smashing Pumpkins Suing Virgin Records

The Smashing Pumpkins are suing Virgin Records, after the label broke terms of their contract by using the band's image in advertising deals.

The advert in question is the "Pepsi Stuff" promotion, in conjunction with Amazon.com and Pepsi Co., which used the group's name and music.

A breach-of-contract lawsuit was filed in Los Angeles Superior Court on Monday March 24th, claiming Billy Corgan and Co. have "worked hard for over two decades to accumulate a considerable amount of goodwill in the eyes of the public."

They claim Virgin's use of their image in a "Pepsi Stuff" has threatened their reputation for "artistic integrity."

At present, the only agreement between Smashing Pumpkins and Virgin, is that the label can sell digital downloads of the band's 17 year back catalogue. The deal does not give Virgin any right to use the band to promote or advertise any outsider products.

The band are seeking an injunction against Virgin using their name or music in a similar, plus they want the profits that were earned in the "Pepsi Stuff" promotion.
